        To:________________________________________________________________________, referred to as “purchaser”,  his/her heirs, and assigns. I , Tricia McCary, acknowledge receipt of a total sum of: $____________ from Purchaser in PARTIAL FULL Payment of the agreed total sum of $__________. In addition, “Purchaser” agrees to assume/pay the balance in full prior to pick-up and hold Tricia McCary without liability from disclosed herein. Sold AS-IS WHERE-IS. No warranties or guarantees implied.

 

DEPOSITS/MONIES RECEIVED ARE HEREBY NON-REFUNDABLE

 

I, Triciasdolls, warrant that there are no liens or encumbrances on the pet sold and that title to the goods is clear and merchantable. I, Triciasdolls, shall defend from any adverse claims to Triciasdolls title to the pet sold.

*** HEALTH CERTIFICATION AND RELEASE***

To the best of Triciasdolls knowledge, all pets are in good health at the time of sale and are sold AS-IS WHERE-IS. Pets have been wormed and first vaccinations given. Therefore, all sales are final.

 

1.        Purchaser has 72 hours (not including weekends) to take this kitten to a licensed Veterinarian to get a health check completed. If the licensed Veterinarian finds this kitten to have a life threatening illness that is non-curable and not treatable, he/she will provide a written statement explaining the findings and the kitten may be returned once the written letter is received, signed by a licensed Veterinarian, and verified. Kitten must be quarantined until it is returned.

2.        Buyer agrees to not co-own the kitten with any breeder.

3.        Neither this kitten nor its offspring may be sold, leased, or given away to a pet store, research laboratory, or any other facility. If breeding rights have been purchased, breeding for the purpose of sale is permitted.

4.        Purchaser agrees to never allow this kitten to roam freely outdoors.

5.        Purchaser agrees to provide this kitten a good and loving home. Kitten will be kept current on all vaccinations and purchaser will make sure that all medical attention and treatment is given if necessary.

6.        This kitten will only be replaced for FIP/FIV/FELV if kitten dies within 14 days of purchase and a written necropsy report stated this being the cause of death and signed by a license Veterinarian.

7.        Triciasdolls cannot guarantee ay show quality or wins on this kitten. Triciasdolls cannot guarantee the quality or quantity of kittens that this kitten produces.

8.        If breeding rights “WERE NOT” purchased, purchaser must spay/neuter kitten within six months of purchase. At that time written documentation of spy/neuter completion must be supplied from a licensed Veterinarian and forwarded to Triciasdolls as proof of spay/neuter completion. If not received no registration papers will be issued.

9.        If this kitten dies before the age of one year due to a congenital or hereditary defect, kitten will be replaced with cat of equal value when one becomes available once a necropsy report is received, signed by a licensed Veterinarian, and verified. There will be no refunds under any circumstances. Pyometra is not guaranteed.

Triciasdolls assumes no responsibility for the pet purchased after it leaves the premises. Upon signing this agreement, Triciasdolls is not responsible for any monies or situations incurred with said pet. Triciasdolls is not responsible for any medical expenses, mortality, landlord disapproval, allergy problems, or any other problem/reasons incurred. No refunds will be made under any circumstances. Replacements will be honored with the above warranted/mentioned protocol followed exactly as stated when needed.

 

I have read and agree with all terms of the Purchase Agreement (page 1) and the Health Certification and Release (page 2) as stated above. I also agree if any legal action must be taken that all legal fees will be my responsibility for both parties and it will be done in the state of Tennessee. If this contract is breeched in any way, the purchaser will owe Triciasdolls a fee of $1500.00 plus legal fees incurred for breech of contract to the seller, Triciasdolls, over and above the original price for each pet purchased and each time this contract may be breeched. Once this contract is breeched, purchaser is to surrender this pet back to Triciasdolls without a refund and at the buyers expense. Furthermore, it is understood and agreed that no warranty or representation has been made with respect to sold animal except as set forth in the above agreement. Having signed and accepted this two page agreement, Purchaser relieves Tricia McCary, Triciasdolls, and all parties involved from any and all responsibilities and liabilities.

This Purchase Agreement is hereby accepted in the state of Tennessee by all said parties.
